El Permiso de Trabajo por Los que Tienen Niños Nacidos en los EEUU y 10 Años En Los EEUU -- Ten Cuidado!


Hay mucha gente ahorita hablando de un permiso de trabajo cuando tienen 10 años en los EEUU y niños nacido aqui. Hablan de esto como si fuera un nuevo beneficio. Pero esto no es verdad,. Vendiendo este programa como un permiso de trabajo sin saber que tienen severas consecuencias .
USCIS no esta dando permisos de trabajo como regalo o galardon por esconderse por 10 años en los EEUU y haber tenido niños aqui. “La Ley de los 10 Años” ha existido desde 1996 y se llame oficialmente " Cancelacion de Deportacion.” Este socorro en la ley requiere lo siguiente:

  1. Tener 10 años consecutivo, sin haber sido deportado antes ,
  2. Tener niños nacidos en los Estados Unidos ,
  3. Tener buen caracter moral quiere decir sin record criminal o que no ha cometido delitos mayores,
  4. La Familia inmediata tiene que tener un sufrimiento extremo si es que usted es deportado,
  5. Ud. esta en procedimientos de deportacion. 
Si, califica en los puntos de arriba , y ha reciido la noticia de su primera audiencia de corte (or el “asilo” has sido pendiente por mas de 150 días), es verdad, que va recibir un permiso de trabajo temporario.  PERO, tambien estara en procedimientos de deportacion!  

Hay que entender, también que los jueces de inmigracion son permitidos de aprobar no mas que 4,000 de estos casos al año en todo el país .  Y, aprueban menos de 10% de estos casos y al fin del caso, si no es aprobado, tendra una orden de deportacion!

Tal vez, ICE estara de acuerdo con darle discrecion del fiscal antes de la decision del juez, tal vez no.

Entonces, lo que esta pasando es que algunos personas estan poniendo pedidas de asilo que no son validos (por que tiene que aplicar por asilo adentro del primer año de su entrada a los EEU), estos casos de “asilo” son basado en un temor general del pais de origen, son negados y referidos a la corte de deportacion. Entonces, simplemente, estos personas estan poniendo su clientes en procedimientos de deportacion por un permiso temporario de trabajo, que sera renovado hasta que el juez decide el caso  (90% del tiempo el caso es negado). 

Por mi parte , no creo que es saludable ni correcto de poner a un cliente en frente del tren de deportacion. Ciertamente sin que el cliente entiende lo que esta haciendo, entrando a procedimiento de deportacion con la casi certeza que ultimamente tendra que salir del pais.

Este abogado en texas esta siendo castigado por no explicar completamente a sus clientes que estan tomando un riesgo inmensa en empezar con el "asilo" aplicando por un permiso de trabajo, pero llegando a la deportacion.
