La Línea y La Espera -- La Lucha Sobre el Boletín de Visas y el Engaño de USCIS

Todo el mundo sabe que hay una "línea" para obtener la residencia permanente legal en los Estados Unidos. La mayoría de los estadounidenses no saben que esta línea puede durar décadas, y que mucha gente en esta línea son en realidad ya residentes en los Estados Unidos, tanto legales como sin papeles. Cada mes, el Departamento de la Oficina de Visas del Estado publica la lista de fechas que están siendo aceptadas para la aprobación de residente permanente. In early September 2015, the Visa Bulletin contained a new second set of dates.  First, there were the dates for those who could be approved for permanent residence.  Second, there was a set of dates for those would while not currently approvable, could file for adjustment of status to be approved in the near future. This was a major change in the Visa Bulletin, and was welcomed by everyone in the immigrant community. El Permiso de Trabajo por Los que Tienen Niños Nacidos en los EEUU y 10 Años En Los EEUU -- Ten Cuidado!

Hay mucha gente ahorita hablando de un permiso de trabajo cuando tienen 10 años en los EEUU y niños nacido aqui. Hablan de esto como si fuera un nuevo beneficio. Pero esto no es verdad,. Important Change in Priority Date Filing Process in October Visa Bulletin

In a surprising move (more for the speed with which they did it, rather than the actual act) USCIS and the Department of State (DOS) announced that beginning with the visa bulletin effective October 1, 2015, USCIS will now accept for filing I-485 adjustment of status applications to adjust status to Permanent Resident according to a separate filing date chart, even though the priority date is not current  This new filing date chart is published in DOS’s Visa Bulletin alongside the usual chart outlining which Priority Dates are current and eligible for actual adjudication that month. This change applies to both Family Based (“FB”) and Employment Based (“EB”) immigrant visa cases. The adjudication of all adjustment of status applications will still be subject to the same per country and per category quotas, and therefore backlogs for those oversubscribed countries and categories will still exist.  BUT, this new adjustment of status filing policy will allow many FB and EB principals
